ARBITRATION NOTICE

SECTION 24 (DISPUTE RESOLUTION) OF THESE TERMS CONTAINS A MUTUAL ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT WAIVES YOUR RIGHT TO A COURT HEARING AND JURY TRIAL4. YOU AGREE THAT ANY AND ALL DISPUTES BETWEEN YOU AND US WILL BE RESOLVED BY BINDING, INDIVIDUAL ARBITRATION AND YOU WAIVE YOUR RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION5.

 

1. ACCEPTANCE OF TERMS

6. SUBSCRIPTION MEMBERSHIPS

  • Automatic Renewal: Your Membership automatically renews for additional, successive periods (each, a "Renewal Membership Period")19.

     

  • Billing: We will automatically bill the Membership fees to your payment method until your Membership is cancelled or terminated20.

     

  • Cancellation: You may cancel your Membership at any time21. You will not receive a refund of any amounts already paid, but you will retain access for the remainder of the then-current period22. To cancel, you may visit your account page or email Pinpipilates000@gmail.com.

     

7. RESTRICTIONS ON USE

You may use the Site and Services solely for your personal use and enjoyment24. Prohibited conduct includes:

 

  • Interfering with the proper functioning of the Site25.

TO THE FULLEST EXTENT PERMITTED BY LAW, THE AGGREGATE LIABILITY OF THE PIN PILATES STUDIO PARTIES TO YOU FOR ALL CLAIMS SHALL NOT EXCEED ONE HUNDRED U.S. DOLLARS (US $100)37373737.

 

12. DISPUTE RESOLUTION

  • Governing Law: These Terms are governed by the laws of the State of Florida38.

     

  • Arbitration: Any dispute shall be submitted to confidential binding arbitration in Broward County or Miami-Dade County, Florida39.

     

  • Timing: Any claim must be commenced within one (1) year after the claim or cause of action arises40.

     

  • Class Action Waiver: ARBITRATION WILL BE CONDUCTED ON AN INDIVIDUAL BASIS ONLY41.
